Massachusetts General Law Chapter 87

Removing a qualifying public tree requires a public hearing with at least seven days’ advance notice. This applies to trees in the public right-of-way, regardless of where a property line falls.

Article 16 Tree Protection & Preservation Bylaw

For private property, Arlington’s Article 16 Tree Protection & Preservation Bylaw applies under specific circumstances: proposed demolition, construction that increases a building’s footprint by 50% or more, or new construction on a vacant lot. Submitting a Tree Plan carries a $50 fee, and removal of a qualifying tree triggers a mitigation payment to the Town’s Tree Fund calculated on a per-inch-of-DBH (diameter at breast height, measured at 4.5 feet above grade) schedule.
